A family home is often the key item in a family law dispute. Solving the question of its value can solve the bulk of quantum (monetary) aspects of the dispute. A valuation can provide an independent record of market value and shows that proper and fair processes have been used. This secures timely information to inform decisions, can be used for later reference and can protect all involved (including advisors). 
For those who prefer to avoid disputes, a property sharing agreement or Relationship Property Agreement can use market valuation as a process method of price setting or distribution. We can assist lawyers in drafting such provisions or executing operative valuation requirements.

The death of a loved one, or the end of a relationship, is a difficult time for most involved and family and estate law often is not as people expect. For this reason we strongly recommend independent legal advice be sought early to give perspective in the legal context. A reliable valuation assessment which can be respected by all those involved and can also act as evidence can expedite a resolution of property related matters. 

We can explain the valuation process, its assumptions and the local market movement (such as quickly rising or falling prices, etc). Structural reports, costs to repair or potential subdivision can be relevant. We can consider these and explain how they might influence the market value. 

Timing is also important. The value may be higher or lower at different points in time. We can explain such market movements. In consultation with us, your lawyer can help frame our instructions as to what valuation date should be adopted. This could be current or based on an historic date such as the date of separation, death, or before or after renovation or alteration work was undertaken. We can also assess rent. We can give a practical market perspective on the difference between usual maintenance of a property as against upgrading and renovation. We regularly deal with these issues in our forensic valuation processes. 

Full access for us to inspect and measure the property is preferable.  In our experience, courts and lawyers usually can make access available for the purpose of a valuer's inspection where there is a dispute. 
However, we can access specialised systems and database information to facilitate an assessment if access is not available.
