We have experience with valuation issues in this context and have prepared expert evidence which has been adopted by the High Court of New Zealand in cases for the valuation of waterfront land and landslip / erosion affected land. We have provided evidence on values of flood zone, low-lying, cliff-side, beach front, riverside and watercourse affected land. We have also valued land with associated marina rights and jetties and have valued seabed leased from the Crown. Peter Bates has also undertaken marina valuation for evidence in the Supreme Court of Queensland.

This is an area where the valuers involved need to have a sound understanding of the nature of land rights. The perceived benefit of land rights (and potentially detrimental obligations) can ebb and flow over time. Such benefits can vary due to changing market preferences. Land rights values can change by changes in bi-laws, zoning, or the physical state and topography within title boundaries. Often significant document review of technical papers prepared by experts from other fields is required. We have experience in dealing with such complex valuations in a realistic manner.
