We prepare real estate valuation evidence. We are not advocates for parties, but provide independent opinion to inform negotiation, mediation, and hearings. We regularly provide evidence for the Family / District Court, High Court of NZ, Australian courts, Weathertightness and construction disputes, public works, rating objection, professional complaints and disciplinary matters (real estate agents and lawyers), tax investigations and arbitrations in New Zealand and offshore. Many other valuation companies decline to be involved in providing evidence for disputes.

We take pride in providing quality service in this necessary field, which allows for the resolution of disputes. We can, and usually do, talk lawyers through the issues arising from valuation reports, by phone or video link (or face to face where possible). We can provide valuation peer reviews and assist litigators to prepare for valuation related cross-examination. Peter Bates regularly engages in public speaking at professional and university seminars and is used to explaining complex valuation concepts to lay people, as is required in a court setting (for details please click here to redirect to our NEWS page).
Peter Bates' legal background helps significantly where complex property rights need to be valued - often saving time and money for clients. Peter has been called as a witness in the Family / District Court, Weather-tight Homes Tribunal (and mediations) and the High Court. For example, in 2014, the High Court at Auckland accepted and adopted Peter's opinion that a property had a nil value (there were landslip, building defect, title and compliance issues). In 2021 the New Zealand Court of Appeal accepted and adopted Peter's expert opinion on valuation matters under the Property Law Act for modification of covenants. It is necessary for the process and best for the client that we do not advocate for you, as a lawyer would. Rather, we provide reliable independent advice which can inform negotiation or be presented to a Court. We do advocate for the correct method to value a property. For this reason matters often settle, prior to court as either or both parties can appreciate the market value issues at an early stage.
If you are a party involved in the above processes, we strongly recommend that you seek expert legal advice. Your lawyer can help work with us to ensure our engagement is appropriate for the case (such as the date of valuation required or any assumptions or documents to which we should refer). Instructions via your lawyer may also protect you by legal privilege laws. We do not provide regulated legal services (other than arbitration), but are a key professional service in disputes involving land value. In some cases we may decline instructions if you have not been advised by a lawyer (such as relationship property disputes).
